Terms and Conditions

1. Rental Agreement By renting beach equipment from Gold Coast Beach Hire (“Company”), the renter (“Customer”) agrees to abide by the terms and conditions outlined in this agreement and comply with the laws of Queensland, Australia.

2. Rental Period

• Rental periods are available on an hourly, daily, or weekly basis.
• Equipment must be returned by the agreed-upon time. Late returns may incur additional fees.

3. Payment & Deposits

• Full payment is required at the time of rental.
• A refundable security deposit may be required for certain equipment.
• Accepted payment methods include credit card and digital payments.

4. Equipment Use & Responsibilities

• Customer agrees to use the equipment only for its intended purpose.
• Equipment must be used responsibly and safely.
• Customer must inspect equipment before use and report any pre-existing damage immediately.
• Customer agrees to comply with all relevant safety and local council regulations.

5. Liability & Damages

• Customer is responsible for any damage, loss, or theft of rented equipment.
• Fees for damages or loss will be deducted from the security deposit or charged separately.
• The Company is not liable for any injuries, accidents, or damages caused by misuse of the equipment.
• The Company complies with Australian Consumer Law (ACL) under the Competition and Consumer Act 2010 (Cth), and any warranties or guarantees required by law are provided.

6. Cancellations & Refunds

• Cancellations must be made at least 24 hours before the rental period for a full refund.
• No refunds will be issued for early returns or unused rental time.
• Refunds due to weather conditions are at the Company’s discretion, except in cases where Australian Consumer Law applies.

7. Weather Policy

• Rentals may be postponed or canceled due to severe weather conditions, provided that the Company is notified of the Customer’s intent at least 1 hour before the rental period begins.
• If the Company accepts cancellation due to weather, the Customer may reschedule or receive a refund.

8. Indemnification

• Customer agrees to indemnify and hold the Company harmless from any claims, damages, injuries, or expenses arising from the use of the rental equipment, except where such liability cannot be excluded under Queensland law.

9. Governing Law

• This agreement shall be governed by the laws of Queensland, Australia, and any disputes will be resolved in accordance with Queensland courts.

10. Agreement Acceptance

• By signing this agreement or completing the rental transaction, the Customer acknowledges that they have read, understood, and agreed to these terms.
